Selected Ordinances of the City of Kansas City, MO
A person causing an accident could be cited with one of these ordinances by a Kansas City, Missouri Police Officer, if the accident occurred within the city limits of Kansas City, MO.
Sec. 70-301. - Careless driving generally.
No person shall drive any vehicle within this city carelessly and heedlessly in disregard of the rights or safety of others, or without due caution and circumspection, or at a speed and in a manner so as to endanger or be likely to endanger any person or property. (Attorney comment: Note that excessive speed could be considered careless driving under this Kansas City ordinance.)
Sec. 70-306. - Careless driving while operating commercial motor vehicle.
No person shall operate a commercial motor vehicle in willful or wanton disregard for the safety of persons or property. As used in this section, the term "commercial motor vehicle" shall mean any motor vehicle designed or used to transport passengers or property if:
(1) The vehicle has a gross combination weight rating of 26,001 or more pounds inclusive of a towed unit which has a gross vehicle weight rating of 10,000 or more pounds;
(2) The vehicle has a gross vehicle weight rating of 26,001 or more pounds;
(3) The vehicle is designed to transport more than 15 passengers, including the driver; or
(4) The vehicle is used in the transportation of hazardous materials in a quantity requiring placarding under regulations issued by the secretary of transportation under the Hazardous Materials Transportation Act (49 USC app. 1801-1813). (Attorney comment: This ordinance of Kansas City pertains to not only to big commercial diesels, but to buses, dump trucks, and garbage trucks as well.)
Sec. 70-332. - Vehicle turning left.
The driver of a vehicle intending to turn to the left shall yield the right-of-way to any vehicle approaching from the opposite direction which is so close as to constitute an immediate hazard. (Attorney comment: Many rear collisions occur from cars waiting to turn left.)
Sec. 70-334. - Vehicle entering street or highway.
The driver of a vehicle about to enter or cross a roadway from any place other than another roadway shall yield the right-of-way to all vehicles approaching on the roadway to be entered or crossed. (Attorney comment: This City of Kansas City ordinance makes it illegal to pull out in front of someone. However, if a rear-end accident results it can be difficult to prove the negligent party.)
