For a chapter 7 bankruptcy, the Debtor will need at a minimum the following documentation:

 

two years of the most recently filed tax returns, both federal and state;

 

6 months of paystubs;

 

car titles;

 

deeds of trusts;

 

6 months of bank statements;

 

and copies of all recent bills received from creditors.

 

Additional documents may be needed to process your case.

 

It is very important to make sure that every asset and every creditor is listed in your bankruptcy paperwork.  I run a credit report in every case which helps to make sure your creditor list is complete. However, some creditors are too recent or do not bother to list themselves on your credit report.  Therefore, it is up to you to make sure that everybody you owe money to is listed in your bankruptcy schedules.  Your bankruptcy schedules consist of the following list of schedules which together with the rest of your paperwork provides a detailed picture of your financial situation.  This overall picture of your financial situation allows the court, the trustee, and your creditors to understand why you are filing bankruptcy and whether you are in a position to pay any of your debts.

C- Property Claimed as Exempt

D- Creditors Holding Secured Claims

E/F- Creditors Holding Unsecured Claims

G- Executory Contracts and Unexpired Leases

H- Codebtors

I-  Current Income of Individual

J- Current Expenditures of Individual Debtors.
